Terms of Service

    1. Introduction

    These Terms of Service ("Terms") govern your use of The SWOT Club website and services. By accessing or using our platform, you agree to be bound by these Terms. If you do not agree, please do not use our services. These Terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act (CPA) and the Electronic Communications and Transactions Act (ECTA).

    2. Services

    The SWOT Club provides personalised online tutoring services for Grade 10–12 students following the CAPS and IEB curricula. Our services include one-on-one tutoring sessions, AI-powered study tools, past paper resources, gamified learning features, and progress tracking. Services are delivered online through our platform.

    3. Eligibility & Accounts

    Users under the age of 18 must have a parent or guardian's consent to use our services. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate and complete information when creating an account.

    4. Lesson Packages & Payments

    Lesson packages are purchased in advance and are valid for the period specified at the time of purchase. Prices are quoted in South African Rand (ZAR) and include VAT where applicable. Payment terms and refund policies are communicated at the time of purchase in accordance with the Consumer Protection Act.

    The Student Platform subscription is billed monthly at R699 and may be cancelled at any time, taking effect from the following month. The platform is currently available for selected grades only; please confirm availability for your grade before subscribing. Refunds are returned less payment-processing fees.

    5. Cancellation & Rescheduling

    Lessons may be rescheduled with at least 24 hours' notice. Lessons cancelled with less than 24 hours' notice may be forfeited. We reserve the right to reschedule lessons due to tutor unavailability, in which case a replacement session will be arranged at no additional cost.

    6. Acceptable Use

    When using our platform, you agree not to:

    • Use the platform for any unlawful purpose
    • Share your account credentials with others
    • Redistribute, copy or resell any content or materials from the platform
    • Harass, abuse or behave inappropriately towards tutors or other users
    • Attempt to access systems or data you are not authorised to access
    • Use automated tools to scrape or extract content from the platform

    7. Intellectual Property

    All content on The SWOT Club platform, including study materials, notes, worksheets, question banks, videos, and software, is the intellectual property of The SWOT Club or its licensors. You may not reproduce, distribute or create derivative works from any platform content without prior written consent.

    8. Tutors

    Our tutors are independently vetted and trained. While we take every reasonable step to ensure tutor quality, tutoring outcomes depend on many factors including student effort and engagement. The SWOT Club does not guarantee specific academic results.

    9. Limitation of Liability

    To the maximum extent permitted by South African law, The SWOT Club shall not be liable for any indirect, incidental, special or consequential damages arising from your use of our services. Our total liability shall not exceed the amount paid by you for the services in the 12 months preceding the claim.

    10. Privacy

    Your use of our services is also governed by our Privacy Policy, which describes how we collect, use and protect your personal information in accordance with POPIA.

    11. Termination

    We reserve the right to suspend or terminate your account if you breach these Terms. You may close your account at any time by contacting us. Upon termination, your right to use the platform ceases immediately. Any unused lesson credits may be refunded at our discretion in accordance with the CPA.

    12. Dispute Resolution

    Any disputes arising from these Terms shall be governed by South African law and subject to the jurisdiction of the South African courts. We encourage you to contact us first at hello@theswotclub.co.za to resolve any issues informally before pursuing legal action.

    13. Changes to These Terms

    We may update these Terms from time to time. Continued use of the platform after changes constitutes acceptance of the revised Terms. We will notify users of material changes via email or platform notification.
